Summary:

A minister of Economic Security was recently appointed in the new Kishida Cabinet, established in October 2021. Additionally, Prime Minister Kishida revealed that the government was preparing an Economic Security Promotion Bill that is being considered for submission to the ordinary Diet session in 2022.

In the context of the conflict of nations, Japan has experienced an expansion of regulations from economic security perspectives, such as foreign direct investment (FDI) regulations, export controls, economic sanctions, cyber security, secret patents, and others. In this presentation, a lawyer who worked for economic security policies and regulations in the Government of Japan will provide you with an overview of Japan’s economic security policy and the trend of regulation amendments from economic security perspectives.

Mr. Shintaro Okawa

Shintaro Okawa is a lawyer at Mori Hamada & Matsumoto. As a lawyer, he handles cross-border transactions and related compliance issues, especially national security regulations such as FDI regulations, export controls, and economic sanctions. Previously, he worked for the Ministry of Economy, Trade, and Industry (specifically in the Trade Control Department and Economic Security Office) from 2019 till 2021. While working for the ministry, he was involved in the amendment of the Foreign Exchange and Foreign Trade Act (FDI Regulation) and in policymaking for the Economic Security Promotion Bill.
