Understanding and Deciphering Conduct Risk: meeting the challenges of overseas and Japanese regulatory agendas

‘Conduct Risk’ is now a major area of focus for global regulators with increasing attention from the Japanese authorities. Conduct risk affects a wide range of activities carried out within firms such as regulatory reporting, financial crime and ensuring the robustness of systems infrastructure. The realization of conduct risk can have a significant negative impact on the activities of a regulated firm and the wider financial system. This is why global and national regulatory bodies expect that combatting conduct risk is an integral part of a firm’s risk management framework.

Tsuyoshi Oyama is the Head of Deloitte`s Center for Risk Management Strategy. He joined Deloitte in 2010 after working 23 years at the Bank of Japan, most recently as deputy director-general in Financial System and Bank Examination Department. Mr. Oyama has expertise in Economic Analysis, Financial Advisory, and Risk & Capital Management, bringing also a wealth of experience to regulatory issues.

David Samach co-leads Deloitte Tohmatsu’s International Financial Services Program. David started his career at Deloitte, then worked at Credit Suisse in New York and London prior to re-joining Deloitte in January of 2015.  He holds an MBA from London Business School and a BS from Duke University.

Akiko Yamakawa, Partner at Freshfields Bruckhaus Deringer will discuss how to manage working hours and overtime issues and provide practical tips. Topics will include:

· Alternative working hours systems available under law

· Overtime regulations, including:

- court precedents;

- practice of the Labour Standards Office;

- recent discussions relating to “White Collar Exemption” and other overtime    regulations and practical ways to mitigate risks.  

She will also provide an update on recent discussions on labour market reforms including the introduction of equal pay for equal work, and payment of severance allowance in lieu of reinstatement.
